Why elder law

Brandon’s grandparents needed care his family struggled to afford. The cost was only part of it. Misinformation about public benefits, and the bureaucracy of actually applying, made a hard season harder. He remembers wanting a clear explanation and getting rumors instead.

That is the standard he uses now. He explains the options in ordinary language, defines the terms families keep hearing (look-back, spend down, Qualified Income Trust), and builds a plan around the family’s goals. He also says plainly when a step people have heard about is not allowed or carries risk. The aim is a path a family can follow, not a stack of jargon.

He practices at Solkoff Legal, P.A., 2605 West Atlantic Avenue, Suite A-103, Delray Beach, Florida 33445. The office phone is (561) 733-4242.

Practice focus

This site describes three areas. Probate and guardianship are not listed as practice areas here.

Elder Law

Counsel for older adults, people with disabilities and the family members coordinating care. The questions are practical: where someone will live, who can make decisions, how a spouse at home stays secure, and which benefits are worth applying for, including Medicaid and, for veterans and surviving spouses, VA pension.

Medicaid & Long-Term Care Planning

Education and planning around Florida's long-term care programs: nursing home Medicaid (ICP) and home and community-based care through SMMC LTC. That includes income and asset rules, the 60-month look-back, the Qualified Income Trust (also called a Miller trust, used when income is over the monthly cap), protections for a spouse at home, and the paperwork families face before or during a care crisis.

Estate Planning

Wills, revocable living trusts, Florida durable powers of attorney, health care surrogate designations and living wills, Lady Bird deeds where they fit, and special needs trusts for a family member with a disability. Each document is prepared so the people you love can follow a written plan.
