Florida Amendment 3 and the homestead exemption: what changes in 2027 and 2028

Voters approved a much larger homestead exemption on November 3, 2026. Here is what the amendment's text says, who qualifies and when, and what doesn't change.

Amendment 3, approved by about 62% of Florida voters on November 3, 2026 (unofficial results, pending certification), raises the homestead exemption for all non-school property taxes to $150,000 starting January 1, 2027 and $250,000 starting January 1, 2028, with inflation adjustments after that. People who were Florida residents by December 31, 2026 may qualify right away, while later arrivals start with the existing exemption and become eligible for the larger one in their fifth year of homestead exemption.

Last checked: As of November 6, 2026, the results are unofficial and certification is pending. Counties must file official returns by November 16, and the Elections Canvassing Commission is scheduled to certify statewide results on November 17, 2026 (Florida Election Watch timeline). The Legislature may pass implementing laws, and the Department of Revenue may issue guidance (PBC Property Appraiser). The residency rule may also face court challenges. This page will be updated when the results are certified and when implementing rules are adopted.

What voters approved

The ballot title was "Increased Homestead Exemption; Lower Cap On Increases In Non-Homestead Property Assessments." In unofficial election-night results, it received 61.98% yes, or 4,917,796 votes, above the 60% needed to amend the Florida Constitution (Florida Election Watch). The Legislature placed it on the ballot as CS/HJR 1-F during a June 2026 special session (Florida Senate). It takes effect January 1, 2027, pending certification of the results.

According to the ballot summary, the amendment does four things:

Raises the homestead exemption for non-school taxes. Requires the Legislature to set a procedure for counties and cities to raise the exemption further, up to full assessed value, and lets special districts do the same if their voters approve. Sets a five-year wait for people who weren't Florida residents on December 31, 2026. Lowers the annual assessment cap on most non-homestead property from 10% to 5%.

It also limits how counties and cities may use property tax revenue to listed purposes, such as public safety, infrastructure and debt service (enrolled text, Art. VII, s. 9).

The new exemption amounts

Today, a homestead gets $25,000 off for all taxes, plus an inflation-adjusted second exemption on value above $50,000 for non-school taxes. For 2026, that is up to $51,411 in total (Florida Department of Revenue).

Under the amendment's text, the exemption is figured separately for school and non-school taxes (enrolled text, Art. VII, s. 6(a)):

School district taxes: up to $25,000, unchanged. All other taxes (county, city, special districts): up to $150,000 beginning January 1, 2027, and up to $250,000 beginning January 1, 2028. The amount is adjusted each year for positive inflation beginning January 1, 2029 (Florida Senate staff summary).

An exemption can't exceed the assessed value. A homestead assessed at $200,000 in 2028 would generally owe no non-school property tax, but it would still owe school taxes and non-ad valorem assessments (PBC Property Appraiser).

Amendment 3, pending certification: the Florida homestead exemption for non-school taxes rises to $150,000 in 2027 and $250,000 in 2028, while the school-tax exemption stays at $25,000. In a hypothetical, a $400,000 home"s non-school taxable value falls from $348,589 to $150,000 by 2028.

Who qualifies, and when

The key date is December 31, 2026. These rows summarize the amendment text and the Palm Beach County Property Appraiser's guidance (enrolled text; PBC Property Appraiser).

  • Your situation

You already have a Florida homestead exemption

    Generally

The larger exemption is applied automatically starting with the 2027 tax year. No new application is needed

  • Your situation

Florida resident by December 31, 2026; first Florida home bought in 2027 or later

    Generally

May qualify for the larger exemption. You still must apply for homestead by March 1

  • Your situation

Not a Florida resident by December 31, 2026

    Generally

Existing exemption first ($25,000 school, $50,000 non-school, adjusted for inflation from 2028); larger exemption beginning in the fifth year of exemption

  • Your situation

Second home, rental or commercial property

    Generally

No homestead exemption; the yearly increase in assessed value for non-school taxes is capped at 5% instead of 10% starting in 2027

Save Our Homes and portability

Save Our Homes still caps yearly increases in a homestead's assessed value at 3% or the change in inflation, whichever is lower (Fla. Stat. 193.155). Portability still lets you carry up to $500,000 of that difference to a new Florida homestead, if you had a homestead exemption on January 1 of any of the three prior years. The amendment text keeps both (enrolled text, Art. VII, s. 4(d)).

The order matters. Save Our Homes and portability lower the assessed value. The new exemption is then subtracted from that lower value. A longtime owner whose assessed value is far below market value may therefore see a large share of the home exempt from non-school taxes. Moving still requires a new homestead application for the new home (PBC Property Appraiser).

What doesn't change

School taxes. They are still figured with the $25,000 exemption and will still appear on most bills (PBC Property Appraiser). Non-ad valorem assessments. Fees such as solid waste and drainage still apply. Qualifying for homestead. The basic test is unchanged: own the home and make it your permanent residence on January 1, and apply by March 1 (Fla. Stat. 196.011). Senior, widow, disability and veterans exemptions. These aren't eliminated. But because the larger exemption lowers taxable value, they may save less, or nothing, on some levies (PBC Property Appraiser). The local-option senior exemptions remain in the constitution (enrolled text, Art. VII, s. 6(d)). Our senior exemptions guide covers them. Tax rates. The amendment doesn't set millage rates. Local budgets and rates are adopted each year.

Planning points for families

For a parent moving to Palm Beach County to be near family, establishing Florida residency by December 31, 2026 may affect how soon the larger exemption applies. Residency is shown by actions: a Florida driver license, voter registration, a declaration of domicile and a Florida address on tax returns. Our moving to Florida guide explains those steps, and its dated note summarizes the amendment for newcomers.

For homes held in a revocable trust or conveyed by a lady bird deed, the homestead exemption generally continues if the owner keeps the required beneficial interest and lives there (Fla. Stat. 196.041). Because the 2027 exemption is applied automatically to existing homesteads, a family changing a deed now may want to confirm with the Property Appraiser that the change doesn't interrupt the exemption.

A before-and-after hypothetical

Assume a Boca Raton couple has had a homestead since 2015, and their 2026 assessed value is $400,000. For simplicity, the assessed value is held flat, and they claim no other exemptions. These are taxable values, not tax bills. As an illustration only, at a hypothetical 15 mills of combined non-school taxes, each $1,000 of exemption saves about $15.

If the same couple had first moved to Florida in March 2027, they would start with the existing exemption and become eligible for the larger exemption beginning in their fifth year of homestead exemption, unless that rule changes. Common questions

Did Florida Amendment 3 pass in 2026?

Yes, in unofficial results. Florida Election Watch reported 61.98% voting yes, above the 60% required to amend the constitution (Florida Election Watch). As of November 6, 2026, certification is pending. The Elections Canvassing Commission is scheduled to certify statewide results on November 17, 2026 (Florida Election Watch timeline). The amendment takes effect January 1, 2027, so it doesn't change 2026 tax bills (PBC Property Appraiser).

Do I need to reapply to get the larger homestead exemption?

Generally no, if you already have a homestead exemption and meet the eligibility rules. The Palm Beach County Property Appraiser says the increased exemption will be applied automatically starting with the 2027 tax year, with no new application or call needed (PBC Property Appraiser). First-time applicants still must apply by March 1 (Fla. Stat. 196.011). You'll see the change on the August 2027 notice of proposed taxes.

Does Amendment 3 lower school property taxes?

No. The larger exemption applies only to non-school taxes, such as county, city and special district taxes (CS/HJR 1-F, enrolled text). For school district taxes, the homestead exemption stays at $25,000 (PBC Property Appraiser). School taxes and non-ad valorem assessments, such as solid waste fees, will still appear on most homestead bills. Save Our Homes continues to limit how fast assessed value grows for both school and non-school taxes.

I'm moving to Florida in 2027. Will I get the $250,000 exemption?

Not at first, under the amendment as written. Someone who wasn't a Florida resident on December 31, 2026 receives the existing exemption on qualifying: $25,000 for school taxes and $50,000 for other taxes, adjusted for inflation from 2028. The larger exemption begins with the fifth year of exemption (CS/HJR 1-F, enrolled text). This applies "to the extent permitted by the U.S. Constitution," and the rule may be affected by legislation or court decisions (PBC Property Appraiser).
